JLR Win Copyright on C type
#41 Re: JLR Win Copyright on C type
Grace...Space....pace....It is just perfect.....probably a few chaps steeped in engine oil and gear ratios came up with it over coffee and biscuits and possibly the odd pipe....cost to Jaguar...hours wages and some coffee and biscuits...wonder what JLR spent on the above!!!

As Old As Time But As Modern As The Hour. The Riley Car Company’s advert always did it for me.

Interesting artical on tbe JLR fiasco on Porter Press website......"Where will this end up? It is alleged, and we have been given two examples, that artists have been threatened with legal action if they do not cease selling their own representations of, in one instance an E-type (we have been sent the relevant Tweet), and in another a Land-Rover."

There are other ways to handle this. Watch this Lamborghini commercial about a true story

I really like this. As you say, what a better way to handle things (and one that will boost the standing of their brand).

Ironically, only this morning there arrived a long e mail from the dreaded Building a Legend people indicating that I can express interest in purchasing a "reimagined " ( a word that immediately sets my teeth on edge ) V12 E type at a mere £415,000 !

Lates update......the Maguussons won their appeal against JLR and were awarded costs. ....however not all good news as the court decided that JLR have the copyright to the C type design ..more details here thanks to Porter press
JLR C-type Replica Court Case - The First Witness
STOP PRESS (23/03/23): We are exceptionally pleased to say that the Magnussons have won their appeal against the lower Swedish court's decision in favour of JLR with regard to their C-type replica which JLR were insisting they must destroy. Not only have the Magnussons won the case but they have been awarded considerable costs. It is, though, not all good news. It seems that this court accepts JLR have copyright in the C-type design (which they incorrectly credited in its entirety to Malcolm Sayer) and so in theory no-one can now build C-type replicas commercially. The Magnussons won because private use of a copyrighted item is permitted. It seems that the Magnussons have bravely won their battle but the larger community may have lost the war.

Surely a result, at least they get to keep and enjoy their build and could sell it privately at will.

Is the copyrighted item different from the sum of its parts?
How does that square with the aftermarket production of replacement panels or the complete bodyshells like Martin Robey make? Or the ability of the likes of SNGB to remanufacture parts and afford them the same "C" number Jaguar gave them? Surely the copyright in the design applies to every item produced in-house and every item Jaguar had bought in from work they subbed out to companies like Abbey Panels.
kind regards
Marek
EDIT:- the irony is that if the aftermarket parts are crap and don't fit, then they can't be a facsimilie of the original, ergo the design is different and not subject to copyright ruling.

All you need is a licensing agreement with JLR.....you can then make what you want....lt dosnt stop them owning the copyright to the design......it just means that after 70 years of JLR not complaining of others keeping up its heritage they can now stop it......

So what if they deny you a licence?
They aren't obliged to play ball with everyone and anyone and they certainly weren't thinking of granting one to the Magnussons for even ONE copy, let alone for resale or trade purposes. Even if you get one, I bet a licence won't come for free. It'd mean the cost of maintaining these cars goes up for all of us.
kind regards
Marek

Steve, does this mean you’ll get working on that C Type again and have it finished by summer
Oh, and getting the 150 on the road at the same time
JLR senior management, lawyers and their PR company should hang their heads in shame. A simple and honest “sorry, we made a mistake and fully apologise” would earn them no end of brownie points and probably get them back into the good books with enthusiasts of the marques, both old and new models and show them to be far more decent people to deal with.

Sadly its all a moot point
Jaguar has sent out letters today. To dealers and employees.
Almost 75 percent of all U.S. dealers will be closing.
The rest who invested in the electric will remain with the exception of ICE repair of old cars.
This news will hit the streets shortly.
Terrible news.......
On the same day the E.U. PUSHES BACK ELECTRIC MANDATES TO 2050!
JAGUAR WENT WOKE AND WILL JOIN THE MANY OTHERS.....GOING BROKE!

JLR selling off cars and pedal cars from the "Warwickshire collection" Looks like the cars they purchased from Dr James Hull. Some Jaguars in there. All offered at no reserve.
