As the title suggests, I seem to getting an oily residue around the petrol cap but also on to the tail gate????
little splatters, anybody else had this problem?

Petrol does not contain oil although will possibly leave a small amount of a waxy residue behind when it evaporates. If it is dark and oily it is possibly oil that has come from else where. Possibly air flow over and under the car has dragged oil from a leak somewhere and vortices have deposited it where you have found it.

Is the car burning oil?
I had similar issues before the rebuild of my V12. Oil was leaking into the cylinders and being burnt during trips. This left more of a sooty residue than oily, if you know what I mean. So an oily residue suggests a leak from the diff, or somewhere on the engine.

John, you probably mean around the petrol lid = on the body.
When the engine is running rich and still cold (choke pulled for first day drive), you get black soothy droplets out of the exhaust. If you then promptly drive the car, with the wind draft these droplets are easily pushed back on the body.
