Michael, the definition is that it needs to be taxed at a nil rate. Every year I get a reminder, and have to re-tax it at a nil rate. If I don't, I have to SORN it as others have said.

Are we sure that we are giving the full story here?
The SORN system started on 31 January 1998. My understanding is/was that SORN only applies to vehicles licenced on or after that date. If a vehicle was already off the road and not taxed or insured when SORN started was the reg. keeper of the vehicle required to retrospectively complete a SORN declaration?

Hi Pete....you may well be correct...there is no info as far as im aware about that on the DVLA website.....worth checking with the DVLA so their is no problem with future registration.....Steve

I did check with DVLA many years ago. My understanding is based on what I can remember of their reply.
I have not thought about it for years until this thread made me think about it again and reassess my understanding. My car was last taxed in 1987. I bought it with no tax before SORN started. Ownership was changed correctly with DVLA i.e new log book. I have never insured it and have never received any reminders from DVLA about tax or SORN.
I would tend to agree with Bentleyjaguar about not needing to SORN his car if it has been off the road since 1980 and not licenced since. If the vehicle has changed Keepers since1998 maybe that makes a difference?
I'm not wishing to put up an argument but what is said here is mostly opinion and as Steve says there appears to be no info. on the DVLA site which clarifies this situation.

This thread is intriguing as there seems to be contradictory understanding or interpretation of the SORN regulations so I had a dig around for some clarification and came across this government document about SORN.

In it is this statement which seems to confirm that Michael and Pete G have got it right after all:

Exemptions

4. These Regulations shall not apply in relation to a vehicle—

(a)which is an exempt vehicle falling within a description specified in paragraph 2, 2A, 3, 23 or 24 of Schedule 2 to the 1994 Act; or

(b)in relation to which the following conditions are satisfied—

(i)neither a vehicle licence nor a nil licence was in force for the vehicle on 31st January 1998;

(ii)such a licence has not been taken out for the vehicle for a period starting after that date; and

(iii)the vehicle has not been used or kept on a public road on or after that date.

So... my ‘62 RHD OTS which I repatriated from a barn in Holland 3 years ago should be exempt from Insurance and SORN?
It has long since lost its original UK Reg (went abroad in ‘78)
It has a NOVA (I registered it for this when I bought it)
It is as yet not registered ...I am planning to do this when the restoration is complete (it’s in bits)

I tried to register it with the heritage certificate 32 years ago but they told me to get an MOT and it would need to be roadworthy first...hence my rebuild. Is this wrong advice? Should I ask again?

Essentially it needs a registration document and Reg number but they won’t until I get it roadworthy

Whether your car is declared SORN or otherwise, you would be well advised to have it insured during its lay up. Anything can happen during the restoration work.

You can insure your car on its VIN.
